The legal and regulatory situation to allow the planting of genetically engineered (GE) crops in Ecuador remains relatively the same as 2021. Commercial cultivation of GE crops is not permitted, however cultivation for research is allowed and an exception exists for GE products without recombinant or foreign DNA in the genome. A ruling by Ecuador’s Constitutional Court in early 2022 now makes it more difficult for the President to authorize exceptions to the GE ban.

Bt cotton (Bacillus thuringiensis) remains the sole crop derived from biotechnology (biotech) approved for commercial cultivation.

On November 15, 2021, the Ministry of Health and Family Welfare/Food Safety and Standards Authority of India (FSSAI) issued draft regulations for Genetically Modified Organisms or Genetically Engineered Organisms, or Living Modified Organisms intended for direct use as food or for processing.

On September 13, 2021, India’s Ministry of Commerce and Industry/Directorate General of Foreign Trade (DGFT), published Notification No. 25/2015-2020, clarifying that it is authorizing the import of consignments of soybean meal and soy cake derived from genetically engineered (GE) soybeans with a bill of lading or lorry (truck) receipt date issued on or before October 31, 2021.
